BIT Law School Participate in the Fourth Session of theUnited Nations "Responsible Space Behavior" Open-ended Working Group


From August 28 to September 1, 2023, the fourth session of the United Nations Open-ended Working Group on Responsible Space Behavior was held in Geneva, Switzerland. Wang Guoyu, a teacher of our academy, was invited by the Department of Arms Control of the Ministry of Foreign Affairs and appointed by the National Space Administration as a member of the Chinese delegation to attend the meeting.

The Working Group, established in 2022 in accordance with the relevant General Assembly resolution, mainly discusses threats to outer space and explores the formulation of relevant norms. It is a more active multilateral process in the field of outer space, which affects the future formulation of rules and security governance in outer space, and has attracted a great deal of attention from the international community. At the first session held in May 2022, Wang Guoyu was invited by the Working Group to make a presentation entitled "How to Define Force Attacks in Outer Space" (video link: https://media.un.org/en/asset/k19/k19h4sk1d1), which triggered heated discussions among delegations. In September 2022, Wang Guoyu was again invited by the Working Group to participate in the conference as an international expert and delivered a keynote speech entitled "How to Identify Threats in Outer Space" (video link https://media.un.org/en/asset/k19/k19h4sk1d1), and was the only person to be invited by the Working Group to deliver a keynote speech throughout the conference. From January 30 to February 3, 2023, as a member of the Chinese delegation, Wang Guoyu went to Geneva to participate in the three sessions. During the negotiation, Wang Guoyu made speeches on the militarization of low-orbit giant constellations, the application of international humanitarian law in outer space, and the relationship between hard and soft law in outer space, etc. Wang Guoyu strongly responded to the views of the relevant delegations, and defended our position while reflecting China's contribution to the work of the Working Group and the process of Arms Control of outer space. At this point, all the discussions in the Working Group have come to an end, and due to the inherent flaws of the "responsible/irresponsible" dichotomic method boasted by the United States and the West, countries were unable to reach agreement on the final report. However, the various proposals and trends put forward by countries in the discussion on the governance of outer space security and the programme for Arms Control of outer space are worthy of high attention, and the games and debates on the concepts, principles, programmes and paths for the governance of outer space will become more and more intense, and the space law team of BIT Will continue to leverage professional strengths, and will actively take part in the relevant consultations and meetings, so as to make due contributions to safeguarding the rights and interests of China's outer space and promoting the process of the international governance of outer space security.
